APPROVAL OF MINUTES  -           October 25, 2010 Regular Meeting and

                                                             Closed Session Minutes Motion was made by Jay Newman, seconded by Frank Conrad to approve the Regular Meeting Minutes and Closed Session Minutes as submitted. During roll call vote all five Committee members voted in the affirmative.

 

REPORT OF GOVERNING BODY MEMBERS

 

Frank Conrad: congratulated Curtis Corson and Jay Newman on their re-election to Township Committee. He reported that Budget workshops should start on schedule beginning the first of the year.

 

Kristine Gabor: discussed a request from Shore Veterinarians asking for a letter of recommendation from the Township for providing Animal Control services. She also discussed Recreation By-laws and requested they be put on a future agenda for adoption. She reported that she attended a soccer game for the Challenger Program, which is program for handicap children.  She commented on the fine program and that it was a pleasure seeing student and parent volunteers working with the children. Ms. Gabor commented that the event was well attended.

 

Curtis Corson, Deputy Mayor, made a motion to hire Brad Hickman as a part-time laborer for the Department of Public Works.  The motion was seconded by Curtis Corson; during roll call vote all five Committee members voted in the affirmative. He congratulated Township Employees who participated in the countywide snowplow rodeo, where they took first place in the 15,000 pounds and over vehicles, and second place in the 15 to 26,000 pound vehicles.

 

Jay Newman: Reminded everyone to change the batteries in their smoke detectors.

 

Richard Palombo, Mayor:  reported on a letter received from Woodbine Mayor William Pikolycky, requesting that the Township nominate a representative to the newly founded Scenic Byway Committee.  He directed that a notice be placed on UTTV and the website. 

He also requested that a new supply of litter bags for pet owners be placed at Amanda’s Field.

 

OTHER REPORTS

 

Wanda Gaglione, Municipal Clerk, Reported that she had one personnel matter for close session.

 

Daniel Young, Municipal Attorney, Reported he had several items for closed session.

 

Paul Dietrich, Municipal Engineer, requested that the Township hire Brad Hickman as a temporary part-time laborer to the DPW.   He also reported that installation of snow fence along Strathmere Beach is progressing nicely with the fence along Whale Beach nearly complete.

        RE: HONORING NICHOLAS ANNARELLI ON ATTAINING THE

                  DESIGNATION OF "EAGLE SCOUT"

WHEREAS, Nicholas Annarelli, has recently achieved the designation of Eagle Scout in the Boy Scouts of America; and

WHEREAS, the Township of Upper wishes to acknowledge this outstanding accomplishment; and

NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Upper, in the County of Cape May and State of New Jersey, as follows:

RESOLVED THAT the Township Committee extends its sincere congratulations to Nicholas on the occasion of his receiving the designation of Eagle Scout and commends him for this outstanding accomplishment and the completion of his Eagle Scout project consisting of the replacement of a steep and badly deteriorated handicap ramp at the Marmora VFW Hall with a newly constructed ramp made of non-slip composite materials. Nicholas also installed vinyl material on the VFW entryway platform, replaced several electrical fixtures which were in poor condition, and replaced the foundation to the rear cement steps; and

FURTHER RESOLVED that the Township Committee extends its congratulations and best wishes to Nicholas’s parents, family and friends on this happy occasion; and it is

FURTHER RESOLVED that the Township Committee also extends its congratulations and appreciation to the Scout Masters and others who give so freely and generously of their time for the benefit of our youth.

THE 2010 OCEAN CITY-UPPER TOWNSHIP NOON ROTARY CLUB’S

ANNUAL TREE LIGHTING CEREMONY

AND EXPRESSING OUR APPRECIATION FOR THEIR CONTRIBUTIONS AND SERVICE TO THIS COMMUNITY

                        WHEREAS, our community has been invited by the Ocean City-Upper Township Noon Rotary Club (also known as the Noon Rotary Club) to gather here this evening in friendship for the Annual Christmas Tree Lighting Ceremony; and

                        WHEREAS, on this festive occasion we acknowledge how fortunate we are to have the Noon Rotary Club here in Upper Township and recognize that they continue the tradition and intent of the first Rotary Clubs formed over 100 years ago and that is to aid the disadvantaged and assist communities in need; and the Noon Rotary Club demonstrates this ideal everyday through their contributions to this community and their charitable work worldwide; and

                        WHEREAS, as part of their community program the Noon Rotary Club has installed and recently dedicated a wooden foot bridge on the lake in the beautiful Cameron Wildlife Sanctuary (Cape May County Park North) located in the Palermo section of Upper Township for all to enjoy and for which we are all very grateful;  

NOW, THEREFORE, BE RESOLVED that this Township Committee on behalf of all our citizens extends its thanks for the community wide holiday program this evening, the improvement at the Cameron Park, and we especially extend our sincerest appreciation to the members of the Ocean City-Upper Township Noon Rotary Club who give so freely and generously of their time for the benefit of our community and the world;

                        WHEREAS, an overpayment has occurred in the account of Robert Johnson, an EMS ambulance billing patient, where the monies sent to the Township of Upper by NJ Medicaid were in excess as evidenced by the attached copy of a letter attached hereto as Exhibit A.

5.      Authorization for the Township of Upper to accept a Subgrant Award of the Federal Fiscal Year 2010 of Department of Homeland Security Emergency Management Performance Grant Program Funding and for the Township Chief Financial Officer to Amend the Budget and certify the Availability of Funds.

RESOLUTION NO.  221-2010

RE:     AUTHORIZATION FOR THE TOWNSHIP OF UPPER

TO ACCEPT A SUBGRANT AWARD OF THE FEDERAL FISCAL YEAR 2010 OF DEPARTMENT OF HOMELAND SECURITY EMERGENCY MANAGEMENT PERFORMANCE GRANT PROGRAM FUNDING AND FOR THE TOWNSHIP CHIEF FINANCIAL OFFICER TO AMEND THE BUDGET

AND CERTIFY THE AVAILABILITY OF FUNDS

_________________________________________________________________________________________

 

            WHEREAS, the Township of Upper, Office of Emergency Management has been awarded State Homeland Security Grant Program Subgrant CFDA #97.042, Award #2010-P130-0511 from the New Jersey State Police Office of Emergency Management.  The Subgrant, consisting of a total amount of $10,000.00, including $5,000.00 Federal Award and $5,000.00 Local Matching Funds, is for the purpose of enhancing Upper Township’s ability to prevent, protect against, respond to and recover from acts of terrorism, natural disasters and other catastrophic events and emergencies; and

 

            WHEREAS, the subgrant award incorporates all conditions and representations contained or made in application and notice of award #2010-EP-EO-0047; and

 

            WHEREAS, the Township of Upper Office of Emergency Management, designated by the New Jersey State Police, Office of Emergency Management, has submitted an Application for Subgrant Award that has been required by the said New Jersey State Police Office of Emergency Management; and

 

            WHEREAS, the Application for Subgrant Award calls for a match in the amount of $5,000.00, which the Township of Upper, Office of Emergency Management adequately satisfies through the 2010 Township of Upper approved budget for Division salaries and wages and fringe benefits.

 

            NOW, THEREFORE, BE IT RESOLVED that Township Committee of Township of Upper here with accepts the award of the FFY10 Homeland Security Emergency Management Performance Grant Program Subgrant in the amount of $5,000.00 Federal Funds from the New Jersey State Police, Office of Emergency Management; and

 

            BE IT FURTHER RESOLVED that the Director of the Division of Local Government Services is requested to approve the insertion of an item of revenue in the budget of the year 2010 in the sum of $5,000.00, which is now available from the New Jersey State Police, Office of Emergency Management in the like amount of $5,000.00 from the aforementioned grant; and

 

            BE IT FURTHER RESOLVED that the like sum of $5,000.00 is hereby appropriated under the caption FFY10 Homeland Security Emergency Management Performance Grant; and

 

            BE IT FURTHER RESOLVED that the Mayor, and the Township Emergency Management Coordinator are authorized to sign the appropriate subgrant award documents; and

 

            BE IT FURTHER RESOLVED that copies of this Resolution shall be forwarded to the New Jersey State Police, Office of Emergency Management, Cape May County Office of Emergency Management; the New Jersey Director of the Division of Local Government Services.

PUBLIC COMMENT

 

Arthur Turner of 383 Marshallville Road:  was concerned with unkempt properties in the Township.  He submitted a report showing a few properties.  The Mayor directed that it be forwarded to the Zoning Officer.

 

CLOSED SESSION

 

  1.   Resolution to conduct a closed meeting pursuant to N.J.S.A. 10:4-12, from                which the public shall be excluded.  Jay Newman read the resolution into the record.

RESOLUTION NO. 223-2010

MOTION GOING INTO CLOSED SESSION

November 8, 2010

I hereby move that a resolution be incorporated into the minutes authorizing the Township Committee to enter into an executive session for the following matters pursuant to the Open Public Meetings Act:

 

MATTERS:

 

1.       Litigation – Grubb v. Upper Township

2.      Contract negotiation – Collective Bargaining Agreement

 

3.      Contract negotiation – Professional Appraiser

4.      Contract negotiation – Shared Services Contract with Cape May County for vehicle maintenance

5.      Personnel matters

 

I also include in my motion the estimated time and the circumstances under which the discussion conducted in closed session can be disclosed to the public as follows:

 

A.        It is anticipated that the matters discussed in closed session may be disclosed to the public upon the determination of the Township Committee that the public interest will no longer be served by such confidentiality.

 

B.        With respect to employment and personnel matters such discussions will be made public if and when formal action is taken or when the individuals involved consent that it can be made public.

 

C.        With respect to contract negotiations such matters will be made public when negotiations have ceased and there is no longer a reason for confidentiality.

 

D.        With respect to litigation matters such discussions will be made public when litigation is complete and the applicable appeal period has expired.

RECONVENE PUBLIC PORTION OF MEETING

 

Motion was made by Jay Newman, second by Curtis Corson to close the executive session and reopen the regular portion of the meeting.  During roll call vote all five Committee members voted in the affirmative.

 

Motion was made by Jay Newman, second by Curtis Corson to hire Michael Jones and LeGore & Jones Appraisal Services at a cost of $2,500 to appraise the former Municipal Building located in Tuckahoe. During roll call vote all five Committee members voted in the affirmative.

Mr. Newman made a motion, seconded by Curtis Corson to appoint Joanne Herron as Alternate Deputy Registrar to the Municipal Clerks Office with salary of $550, (prorated to October for this year). During roll call vote all five Committee members voted in the affirmative.

 

ADJOURNMENT

 

There was no further business for this evening and the meeting was adjourned at 9:08 PM­­­­­­­­­­­­­­­.  Next meeting scheduled for November 22, 2010 at 7:30 P.M.
