APPROVAL OF MINUTES  -         November 9, 2009 Regular Meeting and

                                                             Closed Session Minutes

Motion was made by Jay Newman, second by Barbara Camp to approve the Minutes as written.  During roll call vote, three Committee members voted in the affirmative, Richard Palombo abstained.

 

REPORT OF GOVERNING BODY MEMBERS

 

Mayor Richard Palombo opened his comments with congratulating Committeewoman Barbara Camp on being named as Person of the Year by the Ocean City Rotary Club at the Annual Tree Lighting event held just prior to this meeting.     

He then announced the merger of our Municipal Court with Dennis Township court that will begin on December 1, 2009.  Through a Shared Services Agreement both courts will be held in Upper Township with the same judge and the same court personnel resulting in a cost effective arrangement for both municipalities.

An upcoming event, Santa Paws, will be held on November 28th, 9a.m. to 12p.m. at Shore Veterinarians.  All are invited and funds raised will benefit Beacon Animal Shelter.

The Mayor also reported that both he and Paul Dietrich met with FEMA last week in Strathmere.  It looks favorable that the Township will be eligible to recapture FEMA funds from the damage caused by the recent storm.  There was a loss of approximately 20-30% from the height (depth) of the sand on the beach area and that generally Strathmere fared quite well due to the recent beach replenishment project. Residents on the inlet side found sand drifts on their property.   Dr. Farrell will continue to survey the beaches.  He commented on the fine work the Public Works Department did in clearing the streets and areas affected by storm.

 

Frank Conrad, Committeeman; Reported that a new organization is being formed called the “Upper Township Business Association”.  A tentative informal gathering will be held January 12th  at 5p.m. at the Tuckahoe Inn.  Mr. Conrad will be attending as a member.  Mayor Palombo also expressed an interest in attending.

 

Barbara Camp, Committeewoman; Reported that the Public Works Department has been very busy cleaning up the debris from the recent Nor’easter storm.  She also reported leaf collection has started with crews starting on either end of the Township and working their way inward. 

Mrs. Camp congratulated Kristine Gabor and Richard Palombo on being elected to Committee positions. 

 

Jay Newman, Committeeman; also congratulated Mrs. Camp for being named Person of the Year.  He reported that he has one item for closed session regarding the merger of Dennis Township Court system. 

 

OTHER REPORTS

 

Wanda Gaglione, Municipal Clerk; informed the audience that the Toys for Tots Drive is underway, and that the municipal employees have again adopted a needy Upper Township family for Christmas and that any person interested in assisting could contact the Clerk’s Office for information.

 

Daniel Young, Municipal Attorney; reported that he has a conflict in a matter involving Thomas Tower/Action Supply and the Planning Board and that due to the conflict he requested that a conflict attorney be designated to handle the matter.  Jay Newman made motion to appoint Norman Briggs as special legal conflict council for this matter.  Barbara Camp seconded the motion and during roll call vote all four Committee members present voted in the affirmative.

Mayor Palombo then requested that this issue be placed on the next agenda and that the public may be invited to speak on it. 

Mr. Young then reported he has one Personnel Matter for closed session. 

 

Barbara Spiegel, Finance Officer; requested confirmation of the October 26th closed session Minutes approving reimbursement to the Historical Society the cost for the extermination treatment of insects at the Friendship School.  Frank Conrad made a motion approving reimbursement up to amount allowed for Capital Preservation Maintenance. Jay Newman seconded the motion with all four Committee members voting in the affirmative.

Ms. Spiegel then informed the Committee that the Construction Official will be going on vacation and requested appointment of Bill Bramble as Acting Construction Official during this time period at the cost of $25 per hour.  Motion was made by Jay Newman, second by Barbara Camp to appoint William Bramble as Acting Construction Official in Mr. Kenney’s absence during his vacation.  Motion was seconded by Barbara Camp and during roll call vote all four Committee members voted in the affirmative. 

 

PRESENTATION  

 

1.      Presentation of Resolution No. 217-2009 Re:  Honoring Matthew Annarelli on attaining the Designation of "EAGLE SCOUT".  

Mayor Richard Palombo read the resolution into record and presented a copy to Matthew Annarelli.  The Annarelli family and friends were in attendance.

RE:  CONGRATULATING EMPLOYEE EDWARD CARTER

OF THE UPPER TOWNSHIP RECREATION DEPARTMENT

FOR HIS WINNING ENTRY IN

THE UPPER TOWNSHIP SAFETY AWARD PROGRAM

FOR THE 4TH QUARTER OF 2009

 

          

           WHEREAS, employee Edward Carter is recognized for his efforts to promote safety for his fellow employees and residents of the Township through his participation in the Upper Township Safety Award Program with a submission of a safety suggestion; and

           WHEREAS, Edward’s safety suggestion was chosen by the Upper Township Safety Committee from the entries submitted in the fourth quarter for the promotion of safety for employees and the community; and

           WHEREAS, Edward should be publicly recognized for reporting the need to replace a drainage grate, covering an open hole, near swing set located at Amanda’s Field; and

           NOW, THEREFORE, BE IT RESOLVED, by the Township Committee of the Township of Upper, in the County of Cape May and State of New Jersey, as follows:

1.                        That the Committee extends its appreciation and publicly recognizes Edward Carter on his commitment to safety by his identifying a potential hazard and presenting a solution through participation in the program.

                        WHEREAS, a refund has been recommended by the Upper Township Planning Board in order to refund monies on an application for Block 15, Lot 1 where an extension of a minor subdivision was found to be unnecessary and the monies where collected in error.

                                RE: DECLARING A DEFAULT WITH RESPECT TO

                                         RICHNAN GROUP, L.P. PRINCIPAL AND

SELECTIVE INSURANCE COMPANY OF AMERICAN SURETY      

BOND NO. B194764, WITH

                                   RESPECT TO THAT SUBDIVISION KNOWN AS

                               KILLDEER HILL ROAD,  BLOCK 453, LOT 98.01, IN

                   THE TOWNSHIP OF UPPER, CAPE MAY COUNTY, NEW JERSEY.

________________________________________________________________________

 

WHEREAS, the Planning Board of Upper Township has heretofore approved a major subdivision known as Killdeer Hill Road,  Block 453, Lot 98.01, in the Township of Upper, County of Cape May and State of New Jersey; and

WHEREAS, a condition of approval required the Developer, Richnan Group, L.P., to provide to the Township of Upper a Performance Bond in sufficient amount to cover the construction of improve­ments; and

WHEREAS, such Performance Bond was thereafter provided in accordance with the requirements of the Municipal Land Use Law of New Jersey, N.J.S.A. 40:55D-1, et seq.; and

                        WHEREAS, the Richnan Group, L.P. is the Principal and Selective Insurance Company of America is Surety, under Bond No. B194764; and

WHEREAS, Richnan Group, L.P., has failed to complete the improvements as required by the major subdivision approval granted by the Upper Township Planning Board; and

WHEREAS, the Developer as Principal and Selective Insurance Company of America as Surety, have been placed on notice as to the uncompleted work; and

WHEREAS, as of November 23, 2009, the work required to complete the improvements had not been commenced by the Developer or Surety; and

WHEREAS, by letter dated October 8, 2009, the Developer and the Bonding Company were placed on notice that the Township would declare the Developer, as Principal, to be in default 30 days from such notice and in the event the work was not completed in accordance with the terms of the original approval the Township would claim payment under the Performance Bond for the cost of completion of the work; and

WHEREAS, the Township Committee has duly considered this matter and has received the recommendations of the Township Engineer and the Township Solicitor;

NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Upper, in the County of Cape May and State of New Jersey, as follows:

1.  The allegations of the preamble are incorporated herein by this reference.

                        2.  The Township Committee makes the factual findings and determinations as  set forth in the preamble and incorporates the same herein.

                  3.  Richnan Group, L.P., is hereby declared to be in default of its obligations

 

as Developer of Killdeer Hill Road, a major subdivision within the Township of Upper, 

 

Block 453, Lot 98.01; and

 

4.  The Surety, Selective Insurance Company of America, shall forthwith complete the work or pay over to the Township of Upper the amount of the Performance Bond, the proceeds of which shall be utilized by the Township of Upper to complete the work required by the major subdivision final approval.

                       5.  In the event that the work is not completed forthwith or the Bond proceeds are not paid over to the Township of Upper forthwith, the Township is hereby authorized to commence litigation in the Superior Court of New Jersey against Richnan Group, L.P., Principal, and Selective Insurance Company of America, Surety, as well as any and all other persons, parties or entities responsible or liable.

Jay Newman made motion to approve the following annual salaries by resolution: Judge----$42,000; Prosecutor----$37,500; Public Defender---$19,000; Baliff---$200 per session;

Court Administrator---$64,100; and Deputy Court Administrator---$51,950.  Salaries are effective December 1, 2009.  Motion was seconded by Frank Conrad with all four Committee members voting in the affirmative.
