RE:   APPOINTMENT OF NORMAN W. BRIGGS

TO ACT AS SPECIAL LEGAL COUNSEL

WHEREAS, the Township requires legal counsel to provide legal services in the event a conflict of interest arises in regard to the services provided by the regular Township Solicitor; and

WHEREAS, a resolution is required authorizing the award of such contract for professional services; and

WHEREAS, Norman W. Briggs, Esquire has completed and submitted a Business Entity Disclosure Certification which certifies that Norman W. Briggs, Esquire has not made any reportable contributions to a political or candidate committee in the Township that would bar the award of this contract and that the contract will prohibit Norman W. Briggs, Esquire from making any reportable contributions through the term of the contract; and

NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Upper, in the County of Cape May and State of New Jersey, as follows:

1.  The allegations of the preamble are incorporated herein by this reference.

2.  Norman W. Briggs, Esquire with offices at 15 North Shore Road, Marmora, New Jersey is hereby appointed Special Legal Counsel to handle matters in which the regular Township Solicitor has a conflict of interest as directed by the Township Committee.

3.  This contract shall have a commencement date as of the date of full execution thereof and shall continue for the length of time necessary for completion of the aforesaid legal services, unless sooner terminated by the Township of Upper, at the option of the Township of Upper.

4.  This Contract is awarded without competitive bidding as a “professional service” in accordance with N.J.S.A. 40A:11-5(1)(a) of the New Jersey Local Public Contract Law because  Norman W. Briggs, Esquire has professional knowledge as to legal matters which knowledge is particularly valuable to the Township Committee.

NOTICE OF CONTRACT AWARD

The Township Committee of the Township of Upper, State of New Jersey has awarded the contract without competitive bidding as a professional service pursuant to N.J.S.A. 40A:11-5(1)(a) to Norman W. Briggs, Esquire for legal services. This contract and the resolution authorizing same shall be available for public inspection in the office of the municipal clerk of the Township of Upper, State of New Jersey.

5.  A certificate from the Chief Financial Officer of Upper Township showing the availability of adequate funds for this contract and showing the line item appropriation of the official budget to which this contract will be properly charged has been provided to the governing body and shall be attached to this Resolution and kept in the files of the municipal clerk.

6.  The contractor has registered with the State of New Jersey pursuant to c.57, Laws of 2004 and has provided proof of that registration to the Township of Upper.

7.  The Mayor and the Township Clerk are hereby authorized and directed to execute, on behalf of the Township of Upper, a Professional Contract with Norman W. Briggs, Esquire in accordance with the terms and provisions of the Local Public Contracts Law, subject to and in accordance with the limitations imposed herein. Upon execution of all parties thereto said contract shall become effective.

8.  A copy of this Resolution shall be published in the official newspaper of the Township of Upper within ten (10) days from the date of adoption.

9.  This Resolution shall be effective as of adoption.

SPECIAL EXECUTIVE SESSION   Immediately after the adoption of the resolution, the Township Committee met with special counsel Norman W. Briggs in an executive session at which the public was excluded for reasons of discussion of litigation. Motion by Jay Newman, second by Frank Conrad to close the regular portion of the meeting and go into the executive session for the purpose of discussion of the Joseph and Emma Lou Paynter litigation matter.  During roll call vote all four Committee members present voted in the affirmative.

Minutes will be approved at the next meeting due to lack of a voting quorum.

 

REPORT OF GOVERNING BODY MEMBERS

 

Frank Conrad, reported that another sport, LaCrosse has been added to the Rec. program.  He made a motion to appoint Peter Schuler as the Recreation member in charge of the LaCrosse program, and William Bailey as the Alternate.  Jay Newman seconded the motion with all four Committee members present voting in the affirmative.

He discussed correspondence he received from an organization wanting to hold a sports clinic at the Community Center, “Basketball at the Beach”. It is a for-profit event however they are donating proceeds from the concessions stands back to the association.  The request will be forwarded to the Recreation Committee.  Mr. Young stated that proof of background checks and insurance would need to be provided.

Mr. Conrad reported on the recent rabies clinics in that over 265 animals were inoculated.

 

Barbara Camp, reported that long-time Supervisor of Roads, Jon Grubb has retired and that there is a resolution on this evening’s agenda thanking him for his 32+ years of service to the Township.  She made a motion to appoint Laurence Bond as Supervisor of Roads and LeRoy Shone as Assistant Supervisor of Roads.  There is no change in salary as they both are already working in the acting capacity of those positions with the appropriate salary.  Jay Newman seconded the motion with all four Committee members present voting in the affirmative.  Mrs. Camp also made a motion to appoint Thomas Woolley as Supervising Equipment Operator effective March 14th.  Jay Newman seconded the motion with all four Committee members present voting in the affirmative.

 

Jay Newman, made a motion to hire John Salmons as a part time EMT.  Motion was seconded by Frank Conrad with all four Committee members present voting in the affirmative.  He reported on the recent rainstorms that occurred over the weekend and that they resulted in very little damage to the Township. 

He reported on the Township Committee’s request at the last meeting for him to investigate some issues that arose with the State Police and their response times to Strathmere.  Since then the States budget has been presented and it looks as though the State Police protection of small communities has become an issue again.  He has started to investigate response times and protection afforded us by the State Police.  In addition, he is looking into other avenues we could take if the relationship with the Township and the State Police were to change, including paying the State Police, paying another department to patrol Upper Township, form our own department, or use County Sheriffs.   He stated that although this may be a few years away it is wise for us to look at this now. 

He also reported that the new ambulance is in service.

 

Mayor Richard Palombo, commented on the State Police matter and that the Township gives the State over $400,000 from our court fees collected from traffic tickets.  The issue is if we are paying for police protection could some of that be used to contribute towards that payment.  The state may have overlooked the fact that we contribute that much money.  Also, the Township is over 48% open space much of it state owned property, and there is a requirement that the State patrol their own property.  Mr. Newman also stated that he is extremely happy with the State Police protection and that they do a great job.  Unfortunately circumstances are forcing us to go out and look at other avenues because of the potential monetary issues the state has imposed upon us.

The Mayor reminded everyone of the public meeting on March 12th  from 4PM to 7PM, to discuss the Rt. 49 Bridge Replacement project.  He discussed the Gypsy Moth meeting from last week and that he received a number of calls from sections of Tuckahoe that are not included in the State’s survey spray area.  We have allocated $300,000 to be used for gypsy moth spraying, and he wants to propose the areas affected last year and not included in the survey be sprayed in our second aerial program; at a minimum that all areas be sprayed at least once. 

He reported on a meeting he attended in Strathmere that addressed the new fishing laws and that sometime in the future they may ask for a supporting resolution to assist sport fisherman which are a big part of the tourist attraction in Cape May County. 

He also discussed that with the retirement of Jon Grubb and the passing away of Elizabeth Bergus there are two openings as Emergency Management coordinators.  He proposed meeting with Jay Newman and John Deuter this week and interview applicants to get the positions filled. 

He discussed an Eagle Scout project planned for the Veterans Park on Rt. 9 and a letter we received from the National Parks Service requesting that another sign be placed at the site. 

He made a motion to hire Patricia Smyth as a clerk-typist to the Clerk’s Office.  Motion was seconded by Frank Conrad with all four Committee members present voting in the affirmative.

 

OTHER REPORTS

 

Daniel Young, Municipal Attorney, reported that the B.L. England tax appeal has been withdrawn as a result of a meeting both he and Mayor Palombo attended.

Both he and Paul Dietrich will meet with the NJDEP and Bureau of Tidelands on March 17th to hopefully resolve remaining issues on the long term Strathmere Beach Replenishment project, such as easements and the permitting of it.  They will attempt to get verification from Bureau of Tidelands as to the high tide line so then it would not be necessary to obtain easements on any of the properties that are seaward of that line, which would expedite the program process.

He asked to discuss one item in executive session, that being the Kevin Grubb matter.

 

Paul Dietrich, Municipal Engineer, reported that Upper Township was again a recycling leader in Cape May County.  County statistics show that Upper Township is far exceeding the County expectations as far as recycling and he credits this to the fine work of our Public Works Department.

He reported that the sand hauling into Strathmere is about half complete.  Approximately 6000 cubic yards of sand was placed on the beach last week and he anticipates the balance to be done this week.  The contractor will then start the grading of the slopes phase.  He reported that there were minor losses of sand during the recent storm. 

He reported that within the next couple of days Community Service personnel will be picking up trash along Roosevelt Blvd, Tuckahoe Rd., and on the Strathmere beach. 

 

Patricia Garbutt, Personnel Officer, reported that she had one personnel item to discuss in executive session.

6.      Authorizing the filing of a Recycling Tonnage Grant Application.

RE:  AUTHORIZING THE FILING OF A RECYCLING

TONNAGE GRANT APPLICATION

                            ____________________________________________

           

            WHEREAS, the Mandatory Source Separation and Recycling Act, P.L. 1987, c. 102., has established a recycling fund from which tonnage grants may be made to municipalities in order to encourage local source separation and recycling programs;  and

           

            WHEREAS, it is the intent and spirit of the Mandatory Source Separation and Recycling Act to use the tonnage grants to develop new municipal recycling programs and to continue and expand existing programs; and

           

            WHEREAS, the New Jersey Department of Environmental Protection has promulgated recycling regulations to implement the mandatory Source Separation and Recycling Act; and

           

            WHEREAS, the recycling regulations impose on municipalities certain requirements as a condition for applying for tonnage grants, including, but not limited to, making and keeping accurate verifiable records of materials collected and claimed by the municipality; and

           

            WHEREAS, a Resolution authorizing this municipality to apply for such tonnage grants for calendar year 2008 will memorialize the commitment of this municipality to recycling and indicate the assent of the Township of Upper to the efforts undertaken by the municipality and the requirements contained in the Recycling Act and recycling regulations; and

           

            WHEREAS, such Resolution should designate the individual authorized to ensure that the application is property completed and timely filed.

           

            NOW, THEREFORE BE IT RESOLVED by the Township Committee of the Township of Upper that the Township of Upper hereby endorses the submission of a municipal Recycling Tonnage Grant Application to the New Jersey Department of Environmental Protection and designates Wanda Gaglione, the Township Clerk, P.O. Box 205, Tuckahoe, New Jersey, 08250, to ensure that said application is properly filed.

            WHEREAS, ThomasBreazeale has paid the sum of $2,964.00 for

 

the payment of a building permit; and           

           

WHEREAS, the application for the permit was then withdrawn by the applicant

 

and building permit was never issued; and

 

WHEREAS, it has been recommended by the Upper Township Code

 

Enforcement Officer that a refund in the amount of $2421.20 be given.  Refund amount

 

reflects the nonrefundable State fees and certain nonrefundable fees for plan reviews

 

already performed;

 

 

NOW, THEREFORE BE IT RESOLVED, by the Township Committee of the

WHEREAS, due to the expected heavy Gypsy Moth infestation this year the Township Committee of the Township of Upper has determined a need to authorize a Gypsy Moth second aerial application throughout the Township; and

WHEREAS, pursuant to the provisions of the Local Public Contracts Law, the Township of Upper intends to solicit bids as herein indicated;

NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Upper, in the County of Cape May and State of New Jersey, as follows:

1.  The allegations of the preamble are incorporated herein by this reference.

          2.  The Township Engineer is hereby authorized and directed to prepare specifications, bid documents and solicit bids for the following project:

RE:  A RESOLUTION REQUESTING PERMISSION

FOR THE DEDICATION BY RIDER FOR THE

UPPER TOWNSHIP AFFORDABLE HOUSING ESCROW FUND

       __________________________________________________________________

       WHEREAS, permission is required of the Division of Local Government Services for approval as a dedication by rider of revenues received by a county or municipality when the revenue is not subject to reasonably accurate estimates in advance; and

 

      WHEREAS, N.J.S.A.40A:4-39 provides that the Director of the division of Local Government Services may approve expenditures of moneys by dedication by rider; and

 

     NOW, THEREFORE, BE IT RESOLVED by the Township of Upper, County of Cape May, New Jersey as follows:

 

1.        The Township Committee does hereby request permission of the Director of the Division of Local Government Services to pay expenditures under the provisions of N.J. S. A.40A:4-39, as amended by P.L. 1999,c.292, for the exclusive purposes of depositing and expending funds paid by individuals to offset the costs of operating municipal “fee-based” affordable housing escrow trust fund programs.

2.        The Municipal Clerk is hereby directed to forward two certified copies of this Resolution to the Director of the Division of Local Government Services.

      15.  Resolution supporting Senate Concurrent Resolution No. 50 Proposing A Constitutional Amendment To Establish Annual State Appropriations Cap.

RESOLUTION NO.    075-2008

RE: RESOLUTION SUPPORTING SENATE CONCURRENT RESOLUTION NO. 50 PROPOSING A CONSTITUTIONAL AMENDMENT TO ESTABLISH ANNUAL STATE APPROPRIATIONS CAP

___________________________________________________________________

 

 

WHEREAS, Senate Concurrent Resolution No. 50 proposes an amendment to Article VII, Section II of the Constitution of the State of New Jersey; and

WHEREAS, Concurrent Resolution No. 50, as sponsored by Senator Jeff Van Drew, states that fiscal year spending in excess of the appropriated amount shall not exceed a total four percent (4%) of the prior year appropriation; and

WHEREAS, said resolution further states that the appropriations shall be displayed as line item appropriations, designating a specific amount of money for a particular purpose and not by means of general language committing funds in an unspecified, conditional or contingent amount for any purpose; and

WHEREAS, the Township Committee of the Township of Upper hereby supports Senate Concurrent Resolution No. 50 and recommends the amendment be submitted to the people on the ballot to be used at the next general election; and

NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Upper, in the County of Cape May and State of New Jersey, as follows:
