APPROVAL OF MINUTES  -           August 6, 2007 Regular Meeting and

                                                             Closed Session Minutes

 

REPORT OF GOVERNING BODY MEMBERS

 

Frank Conrad, attended a NJ Transit event.  NJ Transit officials as well as officials from several South Jersey municipalities were invited on a train ride from Richland to Tuckahoe to discuss funding to extend the train service throughout Cape May County.  Mr. Conrad reported that it was well attended and was very productive.

He discussed the “Endless Summer Soccer Tournament” held this past weekend. Over 100 teams participated.

He also discussed the triathlon event this past weekend sponsored by Citytri.  There were over 300 participants. There was discussion on the last minute arrangements the sponsors made that were not approved by the Township such as closing the boat ramp and beach, and closing Harbor Road.  It was suggested that in the future this event be scheduled after Labor Day so that it would not interfere with the boat ramp and beach operations.  

 

Jay Newman, reported that the EMS billing contract has been signed and is in effect.  He discussed NIMS emergency training for Township employees.  A copy of our resolution No. 104-2006 will be sent to County Emergency Management.  He asked that Jeff Pierson be contacted for the next step in NIMS training for employees. 

He reported that Fall sports are beginning and that at a recent football scrimmage there were over 500 people in attendance. 

He also reported on a countywide Emergency Management meeting attended by many Township supervisors recently held on August 8th during which mutual aid, Army Corps of Engineer, FEMA and other services were discussed.

 

Richard Palombo, Mayor, discussed that on September 25th at 10:00 AM the County will hold a Hurricane Preparedness conference that we will attend. 

He reported that the County has awarded a bid for work on Ocean Drive and should be starting the project in the near future. 

He reported that the Township has received a check in the amount of $229,537.00 this year for hosting the MUA. 

He discussed notification from Atlantic City Electric of their plan to install high voltage power lines along the east coast as part improvements to the northeast power grid. 

 

OTHER REPORTS

 

Paul Dietrich, Municipal Engineer, requested that a resolution supporting a County Waste Water Plan be placed on a future agenda.

AS A SEASONAL EMPLOYEE

        TO THE UPPER TOWNSHIP PUBLIC WORKS DEPARTMENT

                              

 

WHEREAS, a need exists to appoint qualified personnel as seasonal employees to the Upper Township Public Works Department to insure optimal operation; and

WHEREAS, a recommendation has been made to the Township Committee and duly considered at the meeting of August 6, 2007; and

WHEREAS, this Resolution is intended to ratify the action heretofore taken; and

NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Upper, in the County of Cape May and State of New Jersey, as follows:

1.  The allegations of the preamble are incorporated herein by this reference.

          2.   Brian Bushong is hereby appointed in a seasonal position effective immediately at a salary of $10.25 per hour in accordance with the Salary Ordinance.

3.                                                          This Resolution ratifies, confirms and approves action taken by the Township Committee, by motion, at the meeting of August 6, 2007.

RE: AUTHORIZING A FIVE (5) YEAR EXTENSION TO THE LEASE BETWEEN TOWNSHIP OF UPPER AND BEACON ANIMAL RESCUE, INC.

FOR THE BUILDING COMMONLY KNOWN AS THE “FORMER ANIMAL SHELTER”

LOCATED ON BUTTER ROAD, PALERMO, NEW JERSEY

WHEREAS, the Township of Upper entered into a Lease Agreement on September 3, 2004 with Beacon Animal Rescue, Inc. for the premises commonly known as the “former Animal Shelter” located on Butter Road, Palermo, New Jersey; and

WHEREAS, the Township of Upper has been advised that Beacon Animal Rescue, Inc. has or will extend the term of said lease for an additional five years as provided in the original Lease Agreement; and

WHEREAS, the Township of Upper has received documentation from Beacon Animal Rescue as to their being a publicly supported organization therefore being exempt from federal income tax under section 501(a) of the Internal Revenue Code as an organization described in section 501 (c)(3); and

NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Upper, in the County of Cape May and State of New Jersey, as follows:

1.  The allegations of the preamble are incorporated herein by this reference.

2.  The Township Committee hereby extends the term of said lease for an additional five years, expiring on September 3, 2012, subject to receipt of valid insurance certificate.

5.  All Township officials and officers are hereby authorized and empowered to take all action deemed necessary or advisable to carry into effect the intent and purpose of this Resolution.

RE: ACCEPTING THE BID OF AND AUTHORIZING THE

EXECUTION OF A CONTRACT WITH VCI EMERGENCY VEHICLE SPECIALISTS, 43 JEFFERSON AVENUE, BERLIN, NJ 08009

AT A COST OF $186,189.77

WHEREAS, the Township of Upper solicited bids for the furnishing and delivery of 2007 or newer Rescue Squad Ambulance vehicle, which bids were received on July 31, 2007; and

WHEREAS, the aforesaid bids were thereafter reviewed by the Township Engineer; and

WHEREAS, the Township Engineer has submitted a recommendation to the Township Committee with respect to the award of said bids; and

WHEREAS, Ordinance No. 012-2007 provides for acquisition of an ambulance by the Township of Upper, in the County of Cape May, New Jersey appropriating $190,000.00 therefore authorizing the issuance of $180,500.00 bonds or notes of the Township of Upper to finance part of the cost thereof; and

WHEREAS, the Township intends to take formal action awarding the bid to the lowest responsible bidder as hereinafter provided;

NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Upper, in the County of Cape May and State of New Jersey, as follows:

1.      The allegations of the preamble are incorporated herein by this reference.

2.      The Township hereby accepts the bid submitted by VCI Emergency Vehicle Specialists, 43 Jefferson Avenue, Berlin, NJ 08009, for the furnishing and delivery of 2007 or newer Rescue Squad Ambulance vehicle, in the amount of $193,689.77 less a trade in of $7,500.00,equaling the amount of $186,189.77 subject to the following:

(A)       The Bidder shall comply with all Bid Documents, including the Notice to Bidders, all of which are hereby incorporated herein by this reference.

(B)              The Contract to be entered into must comply in all respects with applicable federal, state and local laws and regulations.

(C)              The Bidder has registered with the State of New Jersey pursuant to c.57, Laws of 2004 and has provided proof of that registration to the Township of Upper.

3.  The Mayor and Township Clerk are further authorized to execute a Contract with the successful bidder and/or the Chief Financial Officer is hereby authorized, directed and empowered to issue a Purchase Order to the successful bidder in the amount authorized in this Resolution.

RE: ACCEPTING THE BID OF AND AUTHORIZING THE

EXECUTION OF A CONTRACT WITH GALLO GMC TRUCK SALES, INC. OF 389 WHEAT ROAD, VINELAND, NJ 08360

WHEREAS, the Township of Upper solicited bids for the furnishing and delivery of two (2) 2007 or newer 3cy dump trucks, which bids were received on July 31, 2007; and

WHEREAS, the aforesaid bids were thereafter reviewed by the Township Engineer; and

WHEREAS, the Township Engineer has submitted a recommendation to the Township Committee with respect to the award of said bids; and

WHEREAS, the Chief Financial Officer of the Township of Upper has certified the availability of funds attached hereto as “Exhibit A” in a sufficient amount to award a contract for $164,780.00, the line item appropriations to which the contract will be charged are Account Numbers 7-01-44-900-641-611;

WHEREAS, the Township intends to take formal action awarding the bid to the lowest responsible bidder as hereinafter provided;

NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Upper, in the County of Cape May and State of New Jersey, as follows:

3.                  The allegations of the preamble are incorporated herein by this reference.

4.                  The Township hereby accepts the bid submitted by Gallo GMC Truck Sales, Inc., of 389 Wheat Road, Vineland, New Jersey 08360, for the furnishing and delivery of two (2) 2007 or newer 3cy Dump Trucks, in the amount of $83,640.00 per Unit, for a total of $167,280.00 less a trade in of $2,500.00, equaling the amount of $164,780.00 subject to the following:

(A)       The Bidder shall comply with all Bid Documents, including the Notice to Bidders, all of which are hereby incorporated herein by this reference.

(D)              The Contract to be entered into must comply in all respects with applicable federal, state and local laws and regulations.

(E)               The Bidder has registered with the State of New Jersey pursuant to c.57, Laws of 2004 and has provided proof of that registration to the Township of Upper.

WHEREAS, pursuant to the provisions of the Local Public Contracts Law, the Township of Upper intends to solicit bids as herein indicated;

ORDINANCES

 

  1.  Public Hearing and Final Adoption of Ordinance No. 015-2007, RE: AN ORDINANCE AUTHORIZING THE SALE OF LAND TO WIT BLOCK 24 LOTS 3 AND 4 TO THE STATE OF NEW JERSEY.   Mr. Dietrich reported that this property is part of the approach embankment slope for the Dept. of Transportation, Route 49 bridge replacement project.  The consideration for an easement was identical to the assessed value of the tract. A sale rather than entering into an easement agreement would eliminate liability to the Township. During the public portion of the hearing there were no speakers from the public.  Motion was made by Jay Newman, second by Curtis Corson to adopt the ordinance.  During roll call vote all four Committee members present voted in the affirmative.

                                                 ORDINANCE NO. 015-2007

RE: AN ORDINANCE AUTHORIZING THE SALE OF LAND TO WIT BLOCK 24 LOTS 3 AND 4 TO THE STATE OF NEW JERSEY

_________________________________________________________

WHEREAS, the Township of Upper is the owner, in fee, of certain parcels of vacant ground located within the Township of Upper, County of Cape May, and State of New Jersey, set forth on the municipal tax map as Block 24, Lots 3 and 4; and

WHEREAS, the Township has received an offer from the State of New Jersey, by the Commissioner of Transportation, to purchase said parcels; and

WHEREAS, after discussion and deliberation the Township Committee is of the opinion that the sale of said parcels will be in the best interest of the Township; and

WHEREAS, the Township Committee has determined that the fair market value of such parcels is the sum of $3,450.00 as evidenced by the Administrative Determination of Value obtained by the New Jersey Department of Transportation and the assessed value of the property as determined by the Tax Assessor of the Township of Upper; and

NOW, THEREFORE, BE IT ORDAINED by the Township Committee in the Township of Upper, County of Cape May and State of New Jersey as follows:

SECTION 1: The Township of Upper is hereby authorized to sell to the State of New Jersey, by the Commissioner of Transportation, hereafter referred to as The State, the real property commonly known as follows:

Block 24, Lots 3 and 4

in accordance with N.J.S.A. 40A:12-13(b)(1). Pursuant to said statute such sale shall not be for less than the fair market value of said real property and the fair market value of said parcels sold as well as the purchase price of same is hereby established as follows:

Block 24, Lots 3 and 4

Fair Market Value:   $3,450.00

SECTION 2: Prior to said sale, either the Township or The State will obtain a title report from a title company or abstract company licensed to do business in the State of New Jersey.

SECTION 3: The list of property authorized to be sold together with the sale price shall be posted at Township Hall and advertisement of the sale shall be made in a newspaper circulating in the Township within 5 days following enactment of this Ordinance. Offers for the property may thereafter be made to the Township Committee for 20 days following said advertisement. The Township Committee may reconsider this Ordinance not later than 30 days after enactment and thereafter advertise the property for public sale pursuant to N.J.S.A. 40A:12-13(a). The Township Clerk shall file with the Director of the Division of Local Government Services in the Department of Community Affairs sworn affidavits verifying the publication of the foregoing advertisements.

SECTION 4: In the event the Township Committee receives no offers for the property pursuant to the advertisement of same in accordance with N.J.S.A. 40A:12-13(b), The State shall purchase same in accordance with this Ordinance. The Township Committee expressly reserves the right to revoke its authorization to sell the subject real property any time prior to consummation said sale. The Township Committee is authorized to confirm the sale by resolution to complete the transaction pursuant to this Ordinance and N.J.S.A. 40A:12-13.

SECTION 5: At the time of closing, The State shall be required to pay the following sums in addition to the purchase price:

(A)      Any sums required for title insurance.

(B)       The cost of any survey ordered by the purchaser.

(C)       Title company settlement fees covering services to the purchaser.

SECTION 6: The Deed from the Township of Upper shall be what is commonly known as a Bargain and Sale Deed.

SECTION 7: The title to be delivered by the Township shall be free and clear of all taxes up to and including the date when the Deed is delivered and closing takes place.  Purchaser shall be responsible for all taxes thereafter. Unless otherwise specified herein, the purchaser shall be liable for payment of all assessments, of any nature, against said land.

SECTION 8: The title to be delivered by the Township shall be under and subject to all easements and rights of way, recorded and unrecorded, whether for utilities or for others, and shall also be subject to all conditions, reservations and restrictions of record, if any. If the title report discloses an unmarketable condition of title, except as specified herein, the sole remedy of the purchaser shall be limited to the return of payments made to the Township of Upper on account of the purchase price. This sale is under and subject to any riparian claim which may affect said property. Nothing herein shall be construed as obligating the Township of Upper to construct or maintain access roads to any portion of the property being sold. Such property may not qualify for a building permit due to lack of water supply, lack of sewer or septic facilities, lack of access, inadequate lot size, or other reasons, including those reasons set forth below. The purchaser is required to comply with all applicable zoning, building and health ordinances and codes and regulations. The property being sold may be situate in a Flood Hazard Zone. The Township of Upper makes no warranties or representations, expressed or implied, as to the property being offered for sale, the condition or marketability of the title or any other matter. The Township of Upper makes no warranties or representations, expressed or implied, as to whether or not the property being offered for sale contains any wetlands anywhere on the property.  The Township makes no warranties or representations as to any matter of an environmental nature, or otherwise, which may prevent or limit building or construction.

SECTION 9:  All references to Lots and Blocks described herein are to the Lots and Blocks as shown on the Current Official Tax Map of the Township of Upper.

SECTION 10: The provisions of this Ordinance pertaining to this sale shall survive the closing of title and shall not merge into the Deed.

SECTION 11: This Ordinance shall take effect immediately upon final adoption and publication as required by law.

NEW BUSINESS

 

  1. Request for authorization of Change Order No. 1 for the 2007 Paving Project-Arawak Paving Co.  Mr. Dietrich reported that the Paving Project bid came in at $40,000 lower than what was estimated and requested the change order to include Ashcroft Avenue.  Motion to authorize Change Order No. 1 to the Arawak contract by Curtis Corson, second by Jay Newman.  During roll call vote three Committee members voted in the affirmative, Frank Conrad abstained. A resolution will be placed on a future agenda.

 

  1. Request for the reduction of a Performance Guarantee for the Osprey Point development in Block 348, Lot 94.  Mr. Dietrich stated that the reduced bond amount is sufficient to complete the remaining work on the project.  Motion to accept the reduced bond by Jay Newman, second by Frank Conrad with all four Committee members present voting in the affirmative.  A resolution will be placed on a future agenda.

 

  1. Andrew T. Petrella, request to purchase Township owned property, Block 10, Lots 40 and 42.  Mr. and Mrs. Petrella were present this evening, and are the owners of Block 10, Lot 41, and Block 10, Lot 197.  Their lots totaling approximately 16 acres, are located in the Pinelands zone.  The Pinelands require 25 acres to build on.  The Pretrellas are requesting to purchase Township owned Lots 40 & 42 (totaling approximately 9 acres) to obtain the required acreage to build a home.  Lot 197 would be left vacant in accordance with the Land Density Transfer program.  The Township’s policy is not to sell any Township owned property that would create a new building lot because of the affect it would have on the school system and property taxes.  Mr. Petrella requested that the Committee reconsider this policy.  Mr. Newman stated that he was opposed to that because of their responsibility to taxpayers and that it would set precedence that would create many new lots.  Motion to deny request by Curtis Corson, second by Jay Newman with all four Committee members voting in the affirmative.

Frank Dicesari, 7 Bayaire Road, commented about the Boat Ramp fee.  His permanent residence is in Pennsylvania.  He objects to paying the nonresident fee for a Boat Ramp permit. 

 

Michael Jones from 203 Marshall Rd., also commented on the matter.

 

There being no further comments from the public motion was made by Jay Newman, second by Curtis Corson to close the regular portion of the meeting and go into an executive session.  During roll call vote all four members present voted in the affirmative.

 

 

CLOSED SESSION

 

  1.   Resolution to conduct a closed meeting pursuant to N.J.S.A. 10:4-12, from                which the public shall be excluded.

 

RECONVENE PUBLIC PORTION OF MEETING

 

Motion was made by Jay Newman, second by Curtis Corson to appoint Michelle Johnson as Deputy Tax Assessor with the deputy salary of $550; to promote DPW Assistant Supervisor, Laurence Bond to Acting Supervisor with the Supervisor salary; and that Leroy Shone be promoted to Acting Assistant Supervisor with the Assistant Supervisor salary. During roll call vote all three Committee members present voted in the affirmative.

 

ADJOURNMENT

 

There being no further business this evening the meeting was adjourned at 6:10 P.M.  Next meeting scheduled for September 10, 2007 at 7:30 P.M.
